General conditions of sale

Article 1. Purpose and Scope
This contract concerns the sale of goods (Original Works and Art Prints) and is concluded between the seller, Nathalie VAZQUEZ (hereinafter referred to as “the Artist” or “the Seller”), and a buyer (hereinafter referred to as “the Customer”), within the framework of a distance selling system.
Any order placed on the website www.nathalievazquez.fr implies the Customer’s express and unreserved acceptance of these general terms and conditions of sale, which the Customer acknowledges having read prior to placing their order.
The Customer declares to be at least 18 years of age and to have the legal capacity or authorization to place an order on the Website.

Article 3. Product Characteristics
The products offered for sale are Original Works and Art Prints from the artist’s creations.
Each product is presented on the Website with a description mentioning its essential characteristics (dimensions, materials, authenticity, limited edition, etc.). The artist strives to ensure the greatest possible accuracy of information, recognizing that photographs cannot guarantee a perfect likeness, particularly regarding colors, due to screen settings. Fine art prints are produced on demand by a specialized laboratory, using an eco-responsible approach that limits overproduction.
Article 4. Prices and VAT
Product prices are indicated in Euros (€).
VAT not applicable: Prices are net in Euros, in accordance with Article 293B of the French General Tax Code (VAT exemption threshold).
Prices do not include delivery charges, which are billed separately and clearly indicated before final order confirmation.
The Seller reserves the right to modify its prices at any time, it being understood that the price charged to the Customer is the one displayed on the Website at the time the order is confirmed.
Article 5. Orders
The Customer selects the products on the Website.
The Customer completes the identification form and confirms their contact information.
The Customer reviews the order summary and accepts these Terms and Conditions by checking the box provided for this purpose.
The Customer makes the payment under the conditions set out in Article 6.
The order is considered definitively accepted by the Artist after confirmation of payment by the banking partner.
The Artist confirms acceptance of the order by sending a summary email to the address provided by the Customer. The information provided by the Customer when placing the order is binding (address error, etc.).
Article 6. Payment Terms
Payment is due in full at the time of order.
Accepted payment methods are:
By credit card via the secure SumUp payment system
By bank transfer (only upon request)
The artist reserves the right to suspend or cancel any order in the event of payment default or incident.
Article 7. Delivery
7.1. Delivery Times
The artist undertakes to ship the products within two weeks of order acceptance.
This shipping time is in addition to the carrier’s delivery time. These times take into account the production of custom art prints, if applicable.
7.2. Zones and Transport
Deliveries are made within Metropolitan France and the European Union via Colissimo Tracking to the address provided by the Customer.
The goods sold travel at the Customer’s risk from the moment they are picked up by the carrier. It is the Customer’s responsibility to verify the conformity of the package upon delivery.
7.3. Reservations
In the event of damage, missing items, or non-conformity noted upon delivery, the Client is required to make specific reservations on the carrier’s delivery slip and inform the Artist by email at nat@nathalievazquez.fr within 48 hours of receipt.
Article 8. Right of Withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the Client (a non-professional individual) has a period of fourteen calendar days from receipt of the product to exercise their right of withdrawal.
Return shipping costs are the responsibility of the Client. The product must be returned to the address provided, in its original packaging, in perfect condition, and accompanied by all its accessories and certificate of authenticity (if applicable).
Subject to compliance with these conditions, the Seller will proceed with the refund of all sums paid (product price and initial delivery costs) within fourteen days following receipt and verification of the returned product.
Article 9. Legal Guarantee
The Customer benefits from the legal guarantees of conformity (Articles L.217-4 et seq. of the French Consumer Code) and against hidden defects (Articles 1641 et seq. of the French Civil Code).
In the event of non-conformity, the Customer may return the product to the Artist for exchange, repair, or refund, under the conditions provided by law.
Article 10. Intellectual Property (Rights to the Work)
All elements appearing on the website (works, texts, photographs, videos, logos) are and remain the exclusive intellectual property of the artist Nathalie VAZQUEZ (with the exception of the works listed in the legal notices, which are the property of the artists mentioned). The Artist is a member of ADAGP.
The purchase of a work (Original or Print) does not, under any circumstances, entail the transfer of copyright. The Client acquires the physical copy of the artwork but does not acquire the rights to reproduce, display, or distribute it.
Any reproduction, exploitation, or use, even partial, of the elements of the Site or the artworks sold is strictly prohibited without the prior written consent of the Artist and is subject to legal action.
Article 11. Applicable Law and Disputes
11.1. Amicable Settlement and Mediation
These Terms and Conditions are governed by French law.
In the event of a dispute, the Customer must send a written complaint to the Seller (nat@nathalievazquez.fr).
In accordance with the French Consumer Code, the Customer may use the free consumer mediation service to which the Artist is subject:

11.2. Jurisdiction
If an amicable agreement cannot be reached, the Customer may bring the matter before one of the courts with territorial jurisdiction under French law, in particular the court of the place where they resided at the time the contract was concluded.
